Terms of Use – Labour
1. Introduction
These Terms govern the usage of the Labour mobile application provided by GigManav, operated by Prathysta Constructions.
2. Eligibility
- You must be at least 18 years of age.
- You must be legally eligible to work under Indian law.
- You must complete KYC verification (Aadhaar, PAN, Bank details, photo verification).
3. Services Provided
- Viewing nearby job opportunities.
- Accepting or rejecting job requests.
- OTP-based check-in and check-out for work verification.
- Secure payment confirmation after job completion.
4. Labour Responsibilities
- Provide truthful profile and document information.
- Report to work on time after job acceptance.
- Maintain professional and respectful behavior.
- Complete all assigned tasks as agreed with the Hirer.
5. Prohibited Activities
- Creating fake profiles or claiming false experience.
- Accepting multiple jobs simultaneously.
- Misbehavior, theft, harassment, or property damage.
- Sharing OTPs or misusing any app feature.
6. Earnings & Payment Terms
The labourer will be paid based on:
- Agreed hourly or daily rate.
- Successful job completion and OTP verification.
Platform may deduct service fees, penalties, or statutory charges such as TDS.
7. Ratings
Labourers receive ratings based on punctuality, performance, and behaviour. Consistently low ratings may impact visibility and job access.
8. Liability
- GigManav is a technology platform and not the employer of labourers.
- Labourers work independently based on accepted jobs.
- GigManav is not liable for workplace accidents, safety issues, or damages unless mandated by applicable law.
9. Account Suspension
Your account may be suspended or permanently terminated for:
- Fraud or forged documents
- Unsafe, violent, or threatening behaviour
- Job abandonment
- Repeated cancellation or misuse of features
10. Dispute Resolution
Disputes are handled by customer support. Legal matters fall under the jurisdiction of Jaipur, Rajasthan, India.
